Cancellation PolicyThese conditions are applicable to shared boat reservations and private boat reservations of GUJI S.A.

1. PAYMENT TERMS:
The reservation is understood to be formalized once the transfer of 20% of the total corresponding to the amount of the charter has been made.
Likewise, the total payment of the charter is understood to be formalized once the transfer of the remaining 80% has been made effective.
Said payment must be paid 15 days before the charter start date, without reminder from the operator GUJI S.A.
Reservations made less than 15 days before the charter start date must pay in full for the charter.
All bank charges will be borne by the guests.
Reservations made through travel agencies or online platforms are subject to their reservation and cancellation procedures.
NOTE: In reservations on a shared boat, the distribution of the cabins is not individual but double and the places will be occupied in strict order of reservation.

2. CANCELLATION:
The expenses to be paid for canceling the trip will be the following:
- Full refund for cancellations made within 48 hours of booking.
- 70% refund for cancellations made 10 days before the start of the Charter.
- 50% refund for cancellations made 5 days before the start of the charter.
- Cancellations made within 5 days prior to the start of the charter are non-refundable.
If you cannot or do not want to make a trip for any reason, until the moment of boarding, you can designate another person to take your place under the same conditions and with the same obligations that you had, without any additional outlay.
For any communication regarding a trip change or cancellation, it will be enough to send an email to sailingguji@gmail.com, indicating whether it is a cancellation or trip change.
The charter may also be canceled by GUJI S.A due to adverse weather conditions and/or technical problems where the safety of the boat or its passengers is compromised. In these cases, a 100% refund of what was paid will be made, without the right to any compensation. Now, there would be the option to change the charter dates subject to availability.

3. CONDUCT POLICY
The aim is to ensure that all crew can enjoy a safe and enjoyable holiday. For this purpose, these basic rules of behavior have been developed that every person on board must comply with. Protection and security are everyone's responsibility. Therefore, if a person detects dangerous, irregular or inappropriate behavior, he or she must inform the captain. Who, as the first authority on board in accordance with legal provisions and international treaties, will take appropriate measures to guarantee the safety and well-being of all.
In this sense, offensive language, abusive behavior, non-consensual physical contact, smoking inside the boat, excessive alcohol consumption, drug consumption, carrying on board objects that could cause a fire are considered dangerous or inappropriate behaviors. such as irons, electric stoves, candles, incense, etc. Bring on board weapons, explosives or any other object that represents a risk to people or property. As well as carrying out any other behavior that damages or disturbs other guests and/or crew.
In these cases, the corresponding measures will be taken, this includes measures such as disembarkation during the trip of whoever carries out said activities on board. Including the possible intervention of the competent authorities. Such guests will be responsible for any extra costs they may incur for accommodation and emergency return transportation.
Guests must inform the captain if they have allergies to any food or animals before starting the charter, and during the charter they must inform the captain if they have symptoms of gastrointestinal or other illnesses.
In cases where guests suffer from an illness, they are responsible for bringing all the medications they need during the trip, since it is not possible to obtain them in San Blas.
Pregnant women must carry with them a medical certificate proving their good health, as well as their suitability to make the trip. Given the infrastructure of San Blas, guests over 24 weeks pregnant are not accepted. In this sense, GUJI S.A declines any responsibility that may arise, during the trip or after its completion, because of complications in the pregnancy of a pregnant woman or other circumstances related to it.
People with special or elderly needs may travel without companions if they are self-sufficient, so they must take their personal situation into account when organizing their vacation. At the time of boarding, the captain of the ship will evaluate the guests' ability to determine if they are able to travel safely without assistance and may deny them access to the ship or disembark them at the next port.
At all times, parents and/or guardians are responsible for the actions of their children under 18 years of age and of incapacitated persons or dependents in all the situations. Furthermore, this regime of responsibility will always apply, and in this sense, they must not allow their dependents to leave the ship during the trip or carry out dangerous activities without their supervision.
This conduct policy only seeks to ensure that everyone on board enjoys a pleasant and safe experience on their trip.

1. EXCLUSION OF LIABILITY OF GUJI S.A.
GUJI, S.A will in no case be responsible for any loss or damage to the property of its guests, or for their death or injury, whatever the cause.

2. EXCLUSION OF LIABILITY OF GUESTS
The guest will not be responsible for losses or damages that may occur to the boat during the charter period, unless caused by themselves through negligence or failure to comply with the conduct policies. In the latter case, the guests will be responsible for repairing said loss or damage, as well as for indemnifying GUJI S.A for liabilities or losses that may be incurred because of the direct and indirect acts of the guests. These conditions also apply in cases of injury and/or death of a crew member.

3. FORCE MAJEURE
Without prejudice to any other term herein, GUJI S.A. will not be responsible for any loss, damage, injury, or death arising or resulting from any act of God, act of war, act of public enemies, pirates or thieves, assailants, strike, lockout or work restriction. Meteorological causes that entail risk or danger for the vessel or its crew, unforeseen mechanical causes, or any other cause beyond the control of GUJI S.A.

4. GENERAL TERMS AND CONDITIONS
The availability of fresh water and energy consumption on board is not unlimited, and its consumption must be responsibly moderated.
The route and islands planned for each charter are not contractual and must be adapted and modified according to the weather conditions, the state of the sea, the wind and the safety conditions for the crew and the boat that the captain deems. The captain can always modify the itinerary without generating the right to claim from the guest.
By making your reservation, you have agreed to the terms and conditions, the conduct policy, the privacy policy, and the commercial terms as well as the provisions for cookies & internet advertising.
